"Residence, 560 Broadway street; office Postoffice building, Portland. Born in Listowel, Canada, February 26, 1874. Son of James and Emma (Farncomb) McCourt. Married June 28, 1898, to Veva Boothby. Received his education in the public and common schools of California and moved to Oregon November 1890. Attended the Willamette University, Salem, Literary Department, one year, and the Law Department, Willamette University, 1896, graduating therefrom with a degree of L.L.B. Admitted to the bar in Salem, Oregon, June, 1896, and practiced his profession until 1900 in that city, when he moved to Pendleton, where he remained until appointed United States Attorney March 17, 1908. Elected member of House of Representatives, Oregon Legislature, June, 1898, and served Special Session of that year and Regular Session of 1899. Appointed Deputy Prosecuting Attorney Sixth Judicial District, 1905 to 1908. Republican."

OBITUARY: 

JOHN M'COURT PASSES AWAY, Youngest Justice of Supreme Tribunal of State Succumbs to Illness.
Justice John McCourt, of the Oregon supreme court, died at his home at 1311 Court street about 8 o'clock yesterday morning after an illness of nearly two weeks. A complication of ailments provoked by septic poisoning from infection of the teeth, caused his death.
Justice McCourt is survived by his father and mother, Mr. and Mrs. Jame McCourt, of Albany, his widow and one son, John McCourt, of Salem; two brothers James H. McCourt, now in Montana, and Aubrey McCourt of Albany; and five sisters, Minnie, Edith and Gladys, of Albany, Frances, of Portland and Emma, now in California.
Out of respect to Justice McCourt the supreme court adjourned yesterday morning and will not be in session until Monday after the funeral. The funeral will be held Monday at 10:30 o'clock a.m., at the First Presbyterian church of Salem, with Rev. W. W. Long, pastor of the church, and a Presbyterian minister from Portland officiating. Interment will be in IOOF cemetery. High tribute to Justice McCourt were paid today by Governor Pierce and Chief Justice McBride of the supreme court.
"I first knew Judge McCourt as a member of the legislature from Marion county," said Governor Pierce, "He and I practiced law in Pendleton at the same time and often were arrayed against each other in the trial of cases. I knew him as a brilliant lawyer and always held him in the highest esteem. It is a distinct loss to Oregon to lose Judge McCourt at this early period in his life. My relations with him in a personal, legal and official way were always of the pleasantest and I counted him one of my warmest and dearest friends."
Chief Justice McBride said; "The death of Justice McCourt comes as a shock to all of us. The youngest member of the court, he had early forged ahead to the position of one of its ablest and most influential members. He has demonstrated his great ability in every walk of the profession--as a legislator, as United States district attorney, as circuit judge, and on the bench he demonstrated his talents as a lawyer of high abilities and as a judge whose clear insight into difficult questions always commanded respect and admiration. "His relations with his associates were too intimate and tender to speak of in this early hour of bereavement. We mourn his loss as that of a brother and a friend. His family has lost a dear and affectionate husband and father. This court has lost a beloved associate. The state has lost an able and conscientious official. I cannot say more." Justice McCourt was 50 years old. He was born in Listowel, Canada, February 26, 1874, but in his infancy moved with his parents to California. He received his early education in the public schools of California and Oregon, the family moving to Oregon in 1890. Judge McCourt attended Willamette university taking a year in the literary course and then entering the law department of Willamette, from which he was graduated in 1896. In June of that year he was aadmitted to the bar. Mr. McCourt was married in 1898 to Miss Vera Boothby, daughter of Mr. And Mrs. W. F. Boothby.
The Boothby family was one of the prominent Salem families, Mr. Boothby having done notable work in the construction of public and business buildings. Mr. McCourt was elected in 1898 as one of the Marion county representatives in the legislature, serving in the special session of that year and in the regular session of 1899. He practiced law in Salem until 1900 when he moved to Pendleton and practiced his profession. He served as deputy district attorney at Pendleton from 1905 to 1908. In March, 1908, he was appointed by President Roosevelt as United States attorney for Oregon and moved to Portland. He resigned this position in 1913 and entered upon private practice in Portland as a member of the law firm of Veazie, McCourt & Veazie. Governor Olcott appointed Mr. McCourt to a circuit judgeship in Multnomah county in November 1918 to succeed the late Judge C. U. Gantenbein, and he was subsequently elected to succeed himself in that office. When a vacancy on the supreme bench resulted by the resignation of Justice Charles A. Johns, Governor Olcott appointed Judge McCourt as a justice of the supreme court October 8, 1921. He was then elected to the office in November, 1922.
In politics Justice McCourt was a Republican. He was a member of the Presbyyterian church, but had no fraternal affiliations.
