Spanish Gulch Slayer to Die at 8:30 Today
Prison Association and Chaplain Plead for Time to Appeal. 
Reprieve Denied, Courts Apparently Unable to Delay Execution. 
Claude E. Cline, 46 year old Fossil prospector, will go to his death in Oregon's lethal gas chamber at the penitentiary at 8:30 o'clock this morning unless he gains an unexpected reprieve. While Cline, bearing up well, said he wanted "to get it over with," last chance efforts by Rev. P. W. Eriksen, prison chaplain, and the Oregon Prison association to appeal the man's first degree murder conviction appeared to have failed. Rev. Eriksen requested Governor Charles A. Sprague to grant a brief reprieve in order that an appeal to the supreme court might be filed, but the governor said he would not do so. Pointing out that a jury of 12 men had recommended the death sentence, the governor said it was not within his province to interfere with the law's course. Applying to the supreme court for assistance, the chaplain was informed that the court could not act unless it had the record of the case. The only remaining avenue for securing a stay in Cline's behalf, obtaining a certificate of probable cause for appeal, apparently was blocked by the absence of Circuit Judge Carl Hendricks of Fossil on a fishing trip. The judge was reported not to have left a forwarding address. The prison association, maintaining a death penalty should not be carried out before a capital case had been passed upon by the highest state court, urged the granting of a 60-day stay of execution. Cline was convicted at Fossil June 16 for the slaying of George W. Chetty, 35, his Spanish Culch mining partner. He has two children in Nebraska. His divorced wife also is living. Rev. Eriksen said yesterday he would request the federal government to provide for burial of Cline's body in place of the usual cremation. Cline served with a machine gun battalion of the AEF in France. The chaplain baptized Cline as a Lutheran a few days ago and has been visiting him daily.

OBITUARY: 
Claude E. Cline, former resident of Wheeler county, in this city July 26. Survived by parents, Mr. and Mrs. Jim Cline of Huntsville, Ark.; son Dale of Oakland, Neb.; daughter Mary of Oakland, Neb.; brothers, Thomas of Huntsville, Sam of California; sisters, Altha Carlock of Huntsville, Verla Deskin of Joplin, Mo. Graveside services will be held at the IOOF cemetery Tuesday at 1:30 p.m. under the direction of the Clough-Barrick company with Rev. P. W. Erikson officiating.
